Note The term ‘Affordable Bins’ or ‘AB’ or ‘we’or ‘us’or ‘our’ refers to the owner of Affordable Bins Ltd. The term ‘you’ or ‘hirer’ or ‘your’ or ‘user’ refers to you as the customer.

1. The supply of service and bins to you is governed by these terms and conditions.

1.1 Governing law: these terms will be governed by New Zealand law and you agreed to submit to the exclusive jurisdiction of New Zealand courts.
1.2 Change of terms and conditions: Affordable bins may amend and alter these terms any time, any amendment or changes will be up loaded on to our website and shall apply with effect from the date they are uploaded.

2. Price

The price of the services is the price quoted on website at the time of your order and /or agreed at the time of booking. The prices quoted are based on delivery address given at the time of your order, this may subject to change if the address of delivery changes. The price is inclusive of GST and in NZ dollars.

3. Booking

3.3 Txt us 021501786 . We will respond to your txt or email as soon as possible. If you want specific time or urgent delivery please call us to confirm.
3.4 If your suburb is not listed then we do not serve your area. Please do not choose another area and book online without checking with us. Booking incur charges to us and these charges will be pass to you if we have to refund.

4. Payment

4.1 Payment by cash or direct debit.
4.2 All bins must be paid before delivery (or only by cash at the time of delivery). If you are paying by internet banking, the payment must show in our account before the bin will be delivered. Our account number is ASB 12 3489 0026145 00, please mention your address as reference
4.3 In the situation where third party is involved in booking (landlord booking for tenants), the person booking the bin is responsible for payment, damage and overweight charges.

5. Additional payment

5.1 You are responsible to pay Affordable Bins Ltd for any fees incurred for incorrect waste, excessive weight, blocked access, damage to bin (this includes damage done by fire or machinery etc).
5.2 Please make sure, we can access your property as there is $80 futile delivery charge if we can’t deliver the bin for reasons such as narrow driveway or tree. The minimum driveway width should be 2.9 meter
5.3 Overweight charges may apply $20 per 100 kgs or part thereof, overweight tip dockets and receipts can be sent out if requested
5.4 We can’t leave the bin on road or footpath unless you have obtained permit from the council, we can request for a copy of permit.
5.5 If driver has to wait onsite for items to be shifted, cars to be moved, gates to be unlocked etc we have the right to charge waiting time.
5.6 Any expenses, cost or disbursements incurred by Affordable Bins Ltd in recovery or attempted recovery of overdue money, including credit collection agency and/or solicitors cost shall be paid by you in full .

6. Delivery

6.1 Affordable Bins will endeavour to deliver your bin on the booked delivery date but Affordable Bins not be liable for any delay or failure in delivery does not entitle anyone to cancel any order or entitle anyone to a refund or discount.
6.2 If bin has arrived at the scheduled delivery address and turned away then $100 will be charged.
6.3 We are closed on Sunday and public holidays.
6.4 By hiring a bin you give Affordable Bins Ltd authority to take any necessary steps to enter your property to reclaim our bins.

7. Refund policy

Affordable Bins Ltd will provide full refund in respect of any ordered bin not
provided by us.
You are entitle to cancel or change your order prior to delivery of the bin but you must inform us at least 48 hours before dispatch. If you choose to cancel or change later then the cancelation or variation fee of $60 applies.

8. Use of bin

8.1 Hard fill and clean fill bins
a) Hard fill bin is for rocks, concreate, bricks, tiles, asphalt
b) Clean fill bin is either clean clay or clean top soil that does not contain any contaminant e.g rock, rubble, concrete, tree roots etc.
c) You can mix hard fill and clean fill but no general waste in it (please note: if general rubbish is found in hard fill or clean fill bins then general waste rate and weight limit will apply)
8.2 General rubbish and green waste skip bin
a) General rubbish skip bin is for garden rubbish, household rubbish, furniture, office and commercial rubbish, card board, renovation rubbish but you can’t put anything set in clause 8.3
b) The weight limit applies (see clause 8.6)

8.3 While bin is in your possession, you will not
a) Light fires in the bin or
b) Place or allow to be placed any liquid, explosive toxic, dangerous, hazards material, paint, oil, chemical, gas cylinder, polystyrene, car and truck batteries and tyres, no bulk food, bulk glass, hot ash large tree stumps, branches more than 10 cm in diameter, bulk saw dust, acid, solvents, grease, medical waste, excessively odorous material etc or
c) Put asbestos and fibrolite in the bin (please note: if asbestos found in the bin, the tip will arrange removal of this at minimum charges of $2000 will be charged from you or hirer).
8.4 Safety
a) Please do not fill bin beyond top of the bin. Due to the rules and regulations of NZ Transport Safety Authority, NZ Police and the occupational Health & Safety Authority, overloaded and insecure loads cannot be transported
b) Any overloaded bin will be levelled, to do so the driver’s time will be charged from you.
c) Any rubbish is not placed in the bin or left outside beside the bin will not be taken away. The driver is not responsible for determining what you wish to dispose of and what you wish to keep.
8.5 Risk
a) The bin placed once, must not be moved without Affordable Bins Ltd consent. If you do so and we are unable to pick up the bin within reasonable time frame on site or within the agreed rental period, you may be charged for additional time, for our driver on pick up and/or truck towing cost where applicable.
b) You are responsible for loading the bin and knowing its contents. You will be charged for any damage to the bin
8.6 Weight Limits
a) The following weight limits only apply for general and green waste. If you exceed these limits you will be charged as per (see clause5.3)
2 cubic metres (300 kg) 3 Cubic Metres (450 kg)
4.5 cubic metres (700 kg) 6 Cubic Metres (900 kg)
7.5 cubic metres (1100 kg) 9 Cubic Metres (1400 kg)
b) No weight limit for hardfill/cleanfill bins (If any general or green waste is found mixed with the hardfill then general rubbish rates and weight limits will apply.)

9. Liability

a) Affordable Bins Ltd will not be liable for any claim, loss or expenses related to non-supply of bins. You will be responsible for the provision of free and suitable access to and from the delivery sight including removal and reinstatement of any local obstruction.
b) Affordable Bins Ltd will not be liable for any damage done to driveways, overhead or underground services such as cables, drainage, tree, wire etc, however we will take care but not be responsible
c) We will try to meet your needs but bin will be placed at driver’s discretion

10. Privacy

a) Your privacy is very important to Affordable Bins LTD.
b) Personal information provided by you is used only for the purpose of your order. Information will be kept on file for a certain period as a reference if you choose to use us again. This does not include credit card details, once your order is complete the credit card details are destroyed. Your details will not be used for any other purpose. Affordable Bins LTD will not release any of your information to a third party.

11. Force Majeure

Affordable Bins Ltd will not be liable for any failure or delay in complying with any obligation imposed by these terms if the failure or delay arises from any circumstances beyond our control including without limitation, fire, flood, earthquake, explosion, war, insurrection, sabotage, embargo, industrial dispute, transportation, changes in law, delays or disruption by government or government agencies.

12. Limitation of Liability

The liability of Affordable Bins Ltd for any claim damage, loss or expense related to the supply of service is limited to the cost paid or payable by you for those services except where statute expressly requires otherwise to the fullest extent permitted by law, Affordable Bins Ltd will not be liable in any event whether in tort (including negligence) contract or otherwise for any loss of profit or any consequential, indirect or special damage, loss or injury of any kind suffered by you or any other person.

13. Waiver

If at any time Affordable Bins Ltd does not enforce any of these terms or grants you time or other indulgence. Affordable Bins Ltd will not be construed as having waived that term or its rights to later enforce that or any term.

14. Severability

If any portion of these terms each deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.

15 Acceptance of Terms and Conditions

a) The placing of an order or the continuations of business with Affordable Bins Ltd is deemed to be full acceptance of these terms and conditions.
b) These terms and conditions shall prevail over any previously existing terms and conditions of Affordable Bins Ltd, whether written or not the terms and conditions invalidate any previous terms and conditions.
c) If you are not agree with any of our terms and conditions then contact us immediately and do not use the bin supplied.

16. Trade Prices

a) All Prices will be those ruling at the date of invoice
b) All prices are inclusive of GST

17. Payment and Title

a) Unless Affordable Bins Ltd has agreed to extend credit to the Costumer, payment is to be made on delivery of bins.
b) Payment of cheque or by any type of bank transfer will not be considered payment until the payment has been fully cleared through the banking system into Affordable Bins Ltd.’s bank account.
c) Where Affordable Bins has agreed to extend credit to the Customer, all invoices are to be settled in full no later than the twentieth (20th) day of the month following the date of the invoice.
d) If payment is not made in full by due date Affordable Bins Ltd is entitled to charge the customer interest on the unpaid overdue balance at rate of 2% per month above the current overdraft rate charged by our banker, and Affordable Bins Ltd at its option may suspend collection of further bins until the account is paid in full
e) In spite of clause 17c above, all payments shall become immediately due to Affordable Bins Ltd in the event that a receiver is appointed over an
The assets or the undertaking of the customer, or a liquidator is appointed or the customers goes to voluntary liquidation,

18. Consumer Guarantees Act 1993 (the “Act”)

18.1 If you are a consumer under the Act and you are acquiring or holding yourself out as acquiring services for a business purpose, the Act will not apply. Subject to this clause nothing in these terms and conditions will affect your rights as a consumer under the Act.
